Data retention policy
This Privacy Policy (‘policy’) applies to Open Text Corporation and its affiliates (‘OpenText’, ‘we’, ‘us’, ‘our’) and provides information on the collection, use and sharing (‘processing’ or ‘process’) of your personal data (‘personal information’). This includes personal information collected via our websites (‘Website’), our products or personal information collected from you directly, such as in person, via telephone or email, or indirectly through third parties in the course of our business.
OpenText supports the right to privacy and understands the importance of protecting personal information and complying with applicable data protection laws. We have appointed a Data Protection Officer for assisting with questions regarding this policy and the processing of your personal information.

Data archiving and removal policy
Your local applicable law may provide certain rights regarding the use of your personal information. You may request from OpenText access to, correction of, updating of and/or deletion of your personal information, or object our use of your personal information in certain circumstances, in line with applicable data protection law. Your rights may differ according to your place of residence.
Choice/Opting out of Marketing: OpenText offers you the choice of receiving different types of communication and information related to our products and services. You may subscribe to e-newsletters or other publications; you may also elect to receive marketing communications and other special offers from us via email. If at any time you would like to change your communication preferences, we provide unsubscribe links and an opt-out mechanism in all our communications or contact us.
GDPR and UK Data Protection Act: Where the GDPR or UK Data Protection Act applies to EU and UK residents and their personal information, these individuals are afforded additional rights including:
right to object/restrict processing in certain circumstances;
right to request data portability which includes providing personal information to them in a “structured, commonly-used and machine-readable format” in certain circumstances;
right to lodge a complaint with the applicable authority responsible for privacy protection.

Privacy Shield: OpenText complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom and/or Switzerland to the United States. OpenText has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles. If OpenText transfers such personal information to a third party acting as an agent on its behalf, OpenText remains liable if they fail to process personal information in a manner consistent with the Privacy Shield Principles and we are responsible for the event giving rise to the damage.
If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.
If OpenText shares personal information with third parties, OpenText requires these third parties to protect personal information and to restrict their access, use and disclosure of personal information, including the onward transfer of such information, and OpenText remains liable if they fail to meet those obligations and we are responsible for the event giving rise to damage.
In compliance with the Privacy Shield Principles, OpenText commits to resolve complaints about our processing of your personal information. You may direct any such request to OpenText’s Data Protection Officer.
The U.S. Federal Trade Commission has jurisdiction over OpenText’s compliance with the Privacy Shield.
OpenText has further committed to refer unresolved complaints to JAMS, an alternative dispute resolution provider located in the United States, with a global presence. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit JAMS for more information or to file a complaint. The services of JAMS are provided at no cost to you. Under certain circumstances, you may invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms.

Data storage policy
The personal information we process about you and how we collect it can vary depending on (a) the product(s) or service(s) you use; (b) how you use the product or service; (c) how you have interacted with OpenText, and (d) the information that we have obtained from a customer or from a third party with permission to share such information with us.
OpenText may collect personal information about you such as, for example: full name, email address, telephone number, company name, company location, position in company, department, billing information including credit card details where applicable, IP address and how you use our services. OpenText may combine the personal information you provide with information that is not collected directly from you. Data not provided directly by you may be supplied by OpenText’s vendors and/or partners. Refer to Personal Information Collected from Third Parties for additional information.
